FCRA Lawsuits Climb In June

Consumer litigation activity remained elevated in June, with activity under key consumer protection statutes moving in different directions month over month, according to the latest WebRecon report.

Fair Credit Reporting Act lawsuits increased 16.5% in June, and Telephone Consumer Protection Act lawsuits rose 1.2%, while Fair Debt Collection Practices Act lawsuits declined 5.5%. Despite the mixed monthly results, filings under all three statutes remain up by double digits year-to-date, with FCRA lawsuits up 43.1%, TCPA lawsuits up 34.3%, and FDCPA lawsuits up 12.1%.

Consumer Financial Protection Bureau complaints fell 1% in June but are still 30.4% higher year-to-date.

The report also showed that putative class actions represented 76.4% of TCPA lawsuits filed during the month, remaining extraordinarily high by historical standards.

Here is a breakdown of claims under accounts receivable management industry laws, as well as CFPB complaints, for June 2026:

Fair Debt Collection Practices Act

FDCPA lawsuits declined 5.5% in June, with 364 filings. Year-to-date, FDCPA lawsuits are up 12.1%, continuing to track ahead of the same period last year.

Putative class actions accounted for 27 FDCPA lawsuits, or 7.4% of the month’s filings.

Telephone Consumer Protection Act

TCPA lawsuits increased 1.2% in June, with 250 filings. Year-to-date, TCPA lawsuits are up 34.3%.

Of the month’s TCPA filings, 191 were putative class actions, representing 76.4% of all TCPA lawsuits. Although that share was slightly lower than May’s 80%, it remains very high by historical standards.

Fair Credit Reporting Act

FCRA lawsuits saw the largest month-over-month increase among the three major consumer protection statutes in June, rising 16.5% to 981 filings.

Year-to-date, FCRA lawsuits are up 43.1%, continuing the strong momentum seen throughout 2026. Putative class actions accounted for 18 filings, or 1.8% of the month’s FCRA lawsuits.

Consumer Financial Protection Bureau

CFPB complaints declined 1% in June to 27,054 complaints. Despite the slight monthly dip, complaint volume remains well above last year’s pace, increasing 30.4% year-to-date.

The types of debt behind the CFPB complaints were:

  • 2,693 Other debt (10%)
  • 940 Rental debt (3%)
  • 938 Telecommunications debt (3%)
  • 562 Medical debt (2%)
  • 449 Auto debt (2%)
  • 192 Payday loan debt (1%)
  • 70 Federal student loan debt (0%)
  • 63 Private student loan debt (0%)
  • 50 Mortgage debt (0%)
