Equabli, Inc. has filed a civil lawsuit against EverChain LLC in the U.S. District Court for Nevada, with the case currently open and overseen by Judges Cristina D. Silva and Maximiliano D. Couvillier, III. The lawsuit includes motions for a preliminary injunction and a temporary restraining order, with responses due by August 22, 2025.

Equabli claims that it recently has learned that EverChain, one of its competitors in the collections and recovery solutions industry, misappropriated Equabli’s confidential and trade-secret information related to certain of Equabli’s proprietary technology platforms.

Equabli also claims, a former Equabli employee named Rebecca Taylor (“Taylor”) used her Equabli security credentials to photograph hundreds of Equabli confidential computer screenshots before she left Equabli. Equabli also claims when she began employment at EverChain she gave those images to EverChain employees so that EverChain could use Equabli’s confidential information and trade secrets reflected in those images to build a competitive business platform. EverChain employees knew that the Taylor-provided computer screenshot photographs were of Equabli documents. That knowledge of the source of the documents being from a competitor, in combination with the documents being provided in the form of photographs taken from a computer display, raised concerns amongst personnel within EverChain.

Yet, when an EverChain employee raised the issue of impropriety of the possession and use of the Taylor-provided photographed screenshots with EverChain management, those concerns were brushed aside. EverChain’s management knew, or should have known (had it conducted even the barest of investigations) that photographed screenshot images of documents containing critical nonpublic business information of Equabli were pilfered illegally. Equabli brings this action to enjoin EverChain from utilizing its confidential information and trade secrets, and for other relief.

Peter Barden, Spokesperson for EverChain said, “We were shocked and appalled to learn that Rebecca Taylor, a former Equabli employee, tried to pass on information from her previous employer to EverChain. As soon as we learned this, we conducted a swift investigation, confronted her, and allowed her to resign immediately rather than face termination.

“During the investigation, we also learned that Ms. Taylor held, and appears to continue to hold, equity in Equabli. She would not have been hired had she disclosed this information during her job interview.

“We have been working on the EverChain Collect product since 2021, long before Ms. Taylor joined the company. She contributed little to its development. We’re confident that any information she shared with our employees was public and irrelevant to the development of our product.

“We’ve agreed to the preliminary injunction in good faith and continue to work in this direction to bring this matter to a conclusion.”

Key Allegations:

  1. Taylor photographed confidential Equabli documents, including the Master Schema 4.0, EQ Collect 2.0 product requirements, commission rate information, and client lists. ​
  2. These documents were shared with EverChain employees and used to develop EverChain’s competing Recovery Platform and Intelligence branded products. ​
  3. EverChain’s management allegedly ignored concerns raised by its employees regarding the impropriety of using Equabli’s trade secrets. ​

Legal Claims: Equabli asserts claims under:

  • The Defend Trade Secrets Act (18 U.S.C. ​ §§ 1831-39).
  • Nevada Uniform Trade Secrets Act (NRS 600A.010, et seq. ​).
  • Nevada Infringement of Trade Secrets (NRS 603.050, 603.080). ​
  • Nevada Computer Crimes Law (NRS 205.4765, NRS 205.477(2), and NRS 205.511). ​

Relief Sought: ​ Equabli requests:

  • Injunctive relief to prevent EverChain from using or disclosing its trade secrets. ​
  • Deletion of all misappropriated documents. ​
  • Damages for actual losses and unjust enrichment. ​
  • Exemplary damages and attorney’s fees. ​

Overview: Equabli, Inc., a Delaware corporation specializing in proprietary Software as a Service (SaaS) solutions for debt recovery, alleges that EverChain LLC misappropriated its confidential and trade-secret information. ​ The complaint centers on actions by Rebecca Taylor, a former Equabli employee, who allegedly took unauthorized photographs of Equabli’s proprietary documents and shared them with EverChain after joining the company. ​
