Despite monthly swings, all numbers remain elevated year-to-date.
The latest WebRecon data shows a familiar pattern of fluctuation in consumer claims and complaints, with sharp differences in federal laws. After months of elevated numbers, in October, TCPA cases declined by 18.4% and CFPB cases dipped by 8.6%. However, FDCPA and FCRA cases moved in the opposite direction with notable monthly increases (14.9% and 24.7%, respectively).
Despite the month-to-month shifts, all four categories remain higher year-to-date, signaling continued momentum heading into the final stretch of 2025. The data also sheds light on litigation dynamics. Class actions continue to dominate TCPA filings at an unusually high rate, and repeat plaintiffs remain a significant portion of overall activity.
Here is a breakdown of claims under accounts receivable management industry laws, as well as CFPB complaints, for October 2025:
Fair Debt Collection Practices Act (FDCPA)
There were 493 FDCPA cases filed in October, a 14.9% increase from the previous month and 49.4% higher than a year ago. Year-to-date, FDCPA litigation is nearly on par with last year, up by just 2.9% compared to 2024.
Telephone Consumer Protection Act (TCPA)
TCPA litigation dropped to 235 cases in October — down 18.4% month over month but with a notable increase of 45.1% from the same time last year. Year-to-date, TCPA filings remain high, up 56.6% compared to 2024.
Fair Credit Reporting Act (FCRA)
FCRA cases rose in October, from 737 filings in September to 919 filings in October. FCRA litigation remains significantly higher than last year, up 91.9% year over year and 36.4% year-to-date.
Consumer Financial Protection Bureau (CFPB) Complaints
There were 26,476 CFPB complaints in October, marking a slight 8.6% monthly decrease — however, the complaints still rose by a 48.1% increase from a year ago at this time. Year-to-date, CFPB complaints are up 93%, continuing to outpace all other categories.
The types of debt behind the CFPB complaints were:
- 15,067 I do not know (57%)
- 5,184 Other debt (20%)
- 3,009 Credit card debt (11%)
- 871 Rental debt (3%)
- 808 Telecommunications debt (3%)
- 664 Medical debt (3%)
- 483 Auto debt (2%)
- 204 Payday loan debt (1%)
- 66 Federal student loan debt (0%)
- 61 Private student loan debt (0%)
- 59 Mortgage debt (0%)
The most common type of complaint was attempt to collect debt not owed, at 33% or 8,811 complaints, followed by 6,520 complaints that took or threatened to take negative or legal action.
